This Privacy Policy ("Policy") explains how FOMO, Inc. ("FOMO," "Company," "we," "us") collects, uses, and shares personal information in connection with our website at www.sharedvillage.com and the SharedVillage application (together, the "Services"). Please read it together with our Terms of Service.
SharedVillage is used by organizations such as behavioral-health, mental-health, juvenile-justice, and social-services agencies ("Customer Organizations") to manage their own records. It is important to understand the distinction:
Information you give us. Account and contact details such as name, organization, email address, postal address, and telephone number; login credentials; and information you submit when you contact us for support or other purposes.
Information collected automatically. When you use the Services we automatically collect log and device data such as IP address, browser type, operating system, pages viewed, access times, and actions taken, for security, troubleshooting, and to operate and improve the Services.
Cookies and similar technologies. We use strictly necessary cookies to provide secure sign-in and maintain your session, and may use limited functional cookies to remember preferences. You can control cookies through your browser settings, though disabling necessary cookies may affect how the Services work. We do not use the Services to serve third-party advertising.
We do not sell personal information, and we do not share it with third parties for their own marketing. We share personal information only as follows:
Any sharing of PHI is governed by HIPAA and the applicable BAA with the relevant Customer Organization, not by this section.
We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit (HTTPS/TLS), access controls, and authenticated access to records. No method of transmission or storage is completely secure, but we work to protect information consistent with applicable law and, for PHI, the HIPAA Security Rule.
We retain personal information for as long as needed to provide the Services and for legitimate business or legal purposes. Records maintained on behalf of a Customer Organization are retained and deleted in accordance with our agreement with that organization.
The Services are intended for use by Customer Organizations and their authorized staff, not for direct use by children, and we do not knowingly collect personal information directly from children through the website. Where a Customer Organization maintains records about minors within the Services, that information is handled on the organization’s behalf under HIPAA and the applicable BAA.
You may request to access, correct, or update your account information, or opt out of non-essential communications, by contacting us using the details below. Depending on where you live, you may have additional rights under applicable privacy laws; we will honor those rights as required by law. Requests concerning client records held on behalf of a Customer Organization should be directed to that organization.
In the event of a security incident affecting personal information or PHI, we will notify affected individuals and/or the relevant Customer Organization, and any regulators, as and when required by applicable law and our agreements (including HIPAA breach-notification requirements where they apply).
We may update this Policy from time to time. If we make material changes, we will revise the "Last Updated" date above and, where appropriate, provide additional notice.
