This Privacy Policy ("Policy") explains how FOMO, Inc. ("FOMO," "Company," "we," "us") collects, uses, and shares personal information in connection with our website at www.sharedvillage.com and the SharedVillage application (together, the "Services"). Please read it together with our Terms of Service.

Important: Two Different Kinds of Information

SharedVillage is used by organizations such as behavioral-health, mental-health, juvenile-justice, and social-services agencies ("Customer Organizations") to manage their own records. It is important to understand the distinction:

  • Information this Policy covers. This Policy describes how we handle personal information of website visitors and of the individual users (for example, agency staff) who hold accounts to access the Services.
  • Client records, including Protected Health Information (PHI). When a Customer Organization uses SharedVillage to store records about its clients — which may include PHI under the Health Insurance Portability and Accountability Act ("HIPAA") and information about minors — that Customer Organization controls that information. For such information, FOMO acts as a service provider and, where applicable, a HIPAA Business Associate, and we handle it only as permitted by our agreements with the Customer Organization, including any Business Associate Agreement ("BAA"), and as required by law — not under this consumer Policy. If you are a client of a Customer Organization and have questions about how your information is handled, please contact that organization directly.

Information We Collect

Information you give us. Account and contact details such as name, organization, email address, postal address, and telephone number; login credentials; and information you submit when you contact us for support or other purposes.

Information collected automatically. When you use the Services we automatically collect log and device data such as IP address, browser type, operating system, pages viewed, access times, and actions taken, for security, troubleshooting, and to operate and improve the Services.

Cookies and similar technologies. We use strictly necessary cookies to provide secure sign-in and maintain your session, and may use limited functional cookies to remember preferences. You can control cookies through your browser settings, though disabling necessary cookies may affect how the Services work. We do not use the Services to serve third-party advertising.

How We Use Information

  • To provide, operate, secure, maintain, and improve the Services;
  • To authenticate users and protect against fraudulent, unauthorized, or illegal activity;
  • To respond to inquiries and provide customer support;
  • To send service-related communications such as confirmations, technical notices, security alerts, and administrative messages; and
  • To comply with legal obligations and enforce our agreements.

How We Share Information

We do not sell personal information, and we do not share it with third parties for their own marketing. We share personal information only as follows:

  • Service providers. With vendors who perform services for us (such as hosting and infrastructure) under contracts that require them to protect the information and use it only to provide services to us.
  • Legal and safety. To comply with applicable law or valid legal process, to enforce our agreements, and to protect the rights, property, or safety of FOMO, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections and applicable law; any successor will remain bound by commitments at least as protective as this Policy.

Any sharing of PHI is governed by HIPAA and the applicable BAA with the relevant Customer Organization, not by this section.

Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit (HTTPS/TLS), access controls, and authenticated access to records. No method of transmission or storage is completely secure, but we work to protect information consistent with applicable law and, for PHI, the HIPAA Security Rule.

Data Retention

We retain personal information for as long as needed to provide the Services and for legitimate business or legal purposes. Records maintained on behalf of a Customer Organization are retained and deleted in accordance with our agreement with that organization.

Children’s Privacy

The Services are intended for use by Customer Organizations and their authorized staff, not for direct use by children, and we do not knowingly collect personal information directly from children through the website. Where a Customer Organization maintains records about minors within the Services, that information is handled on the organization’s behalf under HIPAA and the applicable BAA.

Your Choices and Rights

You may request to access, correct, or update your account information, or opt out of non-essential communications, by contacting us using the details below. Depending on where you live, you may have additional rights under applicable privacy laws; we will honor those rights as required by law. Requests concerning client records held on behalf of a Customer Organization should be directed to that organization.

Breach Notification

In the event of a security incident affecting personal information or PHI, we will notify affected individuals and/or the relevant Customer Organization, and any regulators, as and when required by applicable law and our agreements (including HIPAA breach-notification requirements where they apply).

Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will revise the "Last Updated" date above and, where appropriate, provide additional notice.
